1. Introduction
This Refunds & Returns Policy outlines the terms applicable to all purchases made through TSA Safety Consultants (Pty) Ltd (herein referred to as “the Company”). We provide custom-designed digital safety documentation and services, and our refund policies reflect the bespoke nature of this offering.
This policy complies with applicable South African laws, including the Consumer Protection Act (No. 68 of 2008) and the Electronic Communications and Transactions Act (No. 25 of 2002).
2. Nature of Services
The Company provides customised digital services such as:

Occupational Health & Safety files

Risk assessments
-
Safety plans and other compliance documents
These are made specifically for each client’s needs and therefore do not qualify for standard returns or exchange policies.
3. Non-Returnable Items
Due to the personalised nature of all products, the Company does not accept returns once the service has been initiated or delivered.
Digital products are non-refundable under Section 42(2)(f) of the ECTA, which exempts customised digital goods from standard return policies.
4. Cancellations
Clients may request a cancellation under the following terms:

Within 24 hours of making payment

Only if no customisation work has commenced
Requests must be sent in writing to [Insert Email], and the Company will confirm eligibility. If approved, a full or partial refund will be processed within 7–10 working days.
5. Refund Eligibility
Refunds may be considered under the following exceptional circumstances:

Duplicate payment

Order placed in error, where work has not started

Service cannot be fulfilled by the Company due to unforeseen limitations
Refunds are issued to the original payment method used.
6. Amendments After Delivery
The Company provides limited post-delivery support for:

Minor adjustments or corrections

Clarifications due to misunderstood requirements
Requests must be made within 5 business days of receiving the completed documentation. Substantial rework or new requests will be billed separately.
7. Client Responsibilities
Clients are responsible for:

Providing accurate and complete input at the time of order

Responding to follow-ups from the Company for clarifications

Reviewing draft and final documents for approval
The Company is not liable for errors resulting from incomplete or incorrect input provided by the client.
8. Dispute Resolution
Should a dispute arise, the Company will first seek to resolve the issue amicably. If unresolved:

The matter may be referred to a certified mediator

Legal action may be taken under South African jurisdiction
All disputes will be handled in accordance with the laws of the Republic of South Africa.
