1. Overview

These Terms & Conditions govern all use of the services provided by TSA Safety Consultants (Pty) Ltd (herein referred to as “the Company”) through its online platform, digital communication, and associated systems.

By engaging with our services, you agree to comply with these terms. Failure to do so may result in refusal of service, cancellation of orders, or legal recourse as permitted under South African law.

3. Services Provided

We offer the design, preparation, and delivery of custom occupational health and safety documentation for South African businesses. All documentation is tailored to the client’s unique needs and complies with the Occupational Health and Safety Act (No. 85 of 1993).

The services offered by TSA Safety Consultants (Pty) Ltd (herein referred to as “the Company”) are provided on a professional, case-specific basis and aim to promote compliance with legal and industry standards.

4. Ordering Process

4.1 Placing an Order

To place an order, clients must:

  • Select required documentation from our website or via email quote.

  • Provide accurate details of their business, project, and OHS needs.

  • Make full payment via EFT or PayStack before any work begins.

4.2 Order Confirmation

Once payment is confirmed, clients receive:

  • An official order confirmation

  • An estimated delivery timeline (typically 3–7 working days)

5. Customisation

All documents are customised per order. Clients are responsible for:

  • Providing accurate and timely information

  • Responding to clarification requests from the Company Failure to provide complete information may delay delivery or affect document quality.

6. Delivery

Completed documents are delivered electronically via:

  • Email

  • Secure download link

Delivery confirmation will be requested. It is the client’s responsibility to ensure the provided email address is functional and monitored.

7. Intellectual Property

All templates, content, and materials remain the intellectual property of TSA Safety Consultants (Pty) Ltd (herein referred to as “the Company”), protected under the Copyright Act (No. 98 of 1978).

Clients receive a non-transferable, non-exclusive license to use the documents for their own internal business purposes. Reproduction, redistribution, or commercial resale is strictly prohibited without written consent from the Company.

8. Limitation of Liability

The Company is not liable for:

  • Non-compliance caused by incorrect or incomplete client input

  • Consequential losses arising from misuse or misinterpretation of documents

  • Delays caused by third-party services or payment processing issues

The maximum liability of the Company is limited to the value of the services paid for by the client.

9. Governing Law

This agreement is governed by the laws of the Republic of South Africa, and any disputes shall be resolved in accordance with South African civil law under the jurisdiction of relevant South African courts.
